IHC restrains RTO from recovering Rs 8.6 billion pending tax from Iesco

ISLAMABAD: A single bench of Islamabad High Court (IHC) on Thursday restrained the Regional Tax Office (RTO) from recovering outstanding tax of Rs 8.6 billion from M/s Islamabad Electric Supply Company.

The bench comprising of Justice Aamer Farooq heard the reference filed against RTO Islamabad in which chief commissioner and other RTO officers were made party. The bench also directed the RTO to decide the fate of the appellant’s appeal pending before the RTO officers.

The appellant had challenged an RTO order, dated May 14, 2014, demanding Rs 8.6 billion as outstanding tax for the fiscal year from July 2012 to June 2013.

The RTO had issued order under provisions of Sales Tax Ordinance, 1990. The appellant had prayed to court to decide on his petition seeking restrictions over recovery of said amount and decision over its appeal pending before the RTO officers.
