Suo-moto notice: LHC seeks reply from FTO on April 12

LAHORE: Suo-moto authority by the Federal Tax Ombudsman challenged in the Lahore High Court (LHC). LHC issued notice to federal government and Federal Tax Ombudsman and sought reply on April 12.

The case was filed by the Commissioner Inland Revenue Jibran Mansoor through his counsel Safder Shaheen Pirzada.

Justice Sajid Mehmood Sethi heard the case. During proceeding, the counsel for appellant appeared before the court and argued that Federal Tax Ombudsman has not authorized to take suo-moto notice on any tax related issue.

He argued that according to the Sub Section 2 of Section 9 of FTO Ordinance, the FTO cannot take suo-moto notice and also Federal Tax Ombudsman cannot take any action in any case which under is under proceeding in the court .

The tax evasion case of renowned electronics company is under trail in court but the Federal Tax Ombudsman take suo-moto action in M/s Orient Electronics Company case.

He prayed that court may declare null and void the authority of suo-moto action by the Federal Tax Ombudsman.
