Tax evasion of Rs13.44m committed by M/s Aslam Qaim Associate uncovered

KARACHI: The Directorate, Customs Post Clearance Audit, has detected the evasion of duties and taxes of Rs13.44million by M/s Aslam Qaim Associate, it is learnt here.

Sources told Customs Today that M/s Aslam Qaim Associate imported a consignment of fancy lights, charging ceiling fans, and got them cleared from the PICT Karachi vide GDs on December 22, 2017 by paying customs duty very low at six percent after claiming the benefit of the SRO 552/2007.

However the subject items were correctly classifiable under the PCT 3614.2407 attracting customs duty at 10 percent and income tax at eight percent, thus, by way of mis-declaration of classification, the company evaded/short-paid Rs13.44million. The goods were cleared by appraiser Ghulam Ali Mastori.

Sources told CT that the importer violated the provisions of Section 33 (6-A) of the Customs Act-1969, Section 12 read with Section 47 of the Sales Tax Act-1990 and Section 247 of Income Tax Ordinance-2001 punishable under clauses (547) and 624 of Section 154(8) of the Customs Act-1969, Section 72 of the Sales Tax Act-1990 and Section 28 & 18 of Income Tax Ordinance-2001 and Section 9-A of the Sales Tax Act-1990 read with chapter X of the Sales Tax Special Procedure Rules-2007 (Special procedures for payment of sales tax by the importers) and under the relevant provisions of Income Tax Ordinance-2001.

The Directorate, Customs Post Clearance Audit, Director PCA Nadeem Memon has said the PCA will audit nine more old cases in the next month.
