Tax exemption: SHC asks M/S Wings Security to file rejoinder on petition

KARACHI: The Sindh High Court (SHC) on Wednesday directed the M / S Wings Security Private Limited to file rejoinder on its petition seeking income tax exemption certificate.

A two-judge bench, comprising Justice Munib Akhter and Justice Abdul Malik Gaddi issued directions while hearing the petition filed by M / S Wings Security.

During the hearing, counsel for the petitioner requested for some future time to file rejoinder. The court adjourned the hearing and continued the interim order made earlier till next date.

Earlier, counsel for the petitioner stated that petitioner is running a security agency hired retired army personals as well as private person and have license obtained same from federal government. The petitioner submitted that it regularly paying renewal fee within stipulated time and written an application to the respondent for granting of exemption in income tax under Section 153 (4) of the Income Tax Ordinance, 2001.

The petitioner added that the exemption was granted and respondent issued exemption certificate which was extended time to time. However, the petitioner filed an application for issuance of exemption certificate from the period January 1, 2016 to June 30, 2016, but it was informed that it had failed to fulfil the conditions laid down in the Ministry of Law and Justice and Human Rights. Therefore, its application was refused/ rejected.

Citing Ministry of Finance secretary, FBR chairman, Karachi Regional Tax Officer -III (RTO-III) Inland Revenue (IR) chief commissioner and Income Tax Zone-I commissioner as the respondents, the counsel pleaded the court to direct the respondents to issue exemption certificate to the petitioner without any further delay.
