KARACHI: The Sindh High Court (SHC) has issued notices to tax authorities and deputy attorney general of Pakistan on a petition filed by M/s Premier Plastic Industries (Pvt) Ltd seeking restoration of its sales tax registration number which was suspended in an alleged tax evasion case.
While hearing the case, a two-member bench, headed by Aqeel Ahmed Abbasi, also directed them to file their respective comments on the next date of hearing.
Earlier, counsel for the petitioner stated that petitioner is carrying business manufacturing of packing material and plastic bags and paying all taxes and fulfilling all requirements under the Customs Act, 1969.
According to the petitioner, however, without issuing any show cause notice and intimation notice Inland Revenue (IR) deputy commissioner and others officers raided the premises of the petitioner and after searched the factory alleged that petitioner is involved in tax evasion.
The counsel further argued that said allegation has no based and unlawfully, on mala fide intention, respondents issue notice to the petitioner and suspended its sales tax registration no illegally.
Citing Ministry of Law sectary, Federal Board of Revenue (FBR) chairman, IR commissioner and deputy commissioner as respondents, the petitioner pleaded the court may set aside impugned notice and restoration of its sales tax registration no.
The petitioner also pleaded the court may restrain them from taking any coercive action against the petitioner.
