Violation of Companies Ordinance 1984: LHC stays appointments of Fesco CEO, MD

LAHORE: The Lahore High Court (LHC) has stopped process for the appointment of Faisalabad Electric Supply Company (Fesco) Chief Executive Officer and Managing Director and sought reply from the ministry of water and power in the next hearing.

Justice Shahid Karim, adjourning further proceedings till next hearing on Feb 06, granted the petition of a law officer on behalf of the federal government and the Fesco who sought time to submit replies on the matter.

Fesco Engineers Association had challenged the appointment process for the appointment of Fesco CEO and MD alleging that the ministry violated the principles set by the superior courts.

The association had filed the petition through their counsel advocate Azhar Siddique submitting that board of directors was the competent authority to make the appointment of the company’s CEO and MD under Companies Ordinance 1984. However, he said, the ministry bypassed the rules and directly advertised the vacancies.

The counsel asked the court to set aside the appointment process for being illegal. Counsel of federal government and the Fesco sought time to submit their replies on the matter.
