Adjudication risks contempt of court proceedings due to lack of information about court cases

KARACHI: The Collectorate of Customs Adjudication has expressed concern over not informing the authorities regarding the cases which are in courts and in the adjudication collectorate at the same time.

The sources in the Collectorate of Customs Adjudication informed Customs Today that the departmental representatives of the collectorates, directorate and the aggrieved parties also are not informing the adjudication authorities that their cases are also in the courts which may increases the risk of contempt, as the authorities of Customs Adjudication are not aware by the facts that the same case which is adjudicating the Customs authorities is also in courts including Supreme Court of Pakistan, Sind High Court, Session Court or any other related court.

The sources said that the departmental representatives and the aggrieved parties kept the Adjudicating authorities in dark, which increases the contempt of Court risk for the Customs authorities.

To a query, sources informed this scribe that the authorities concerned of the Collectorate of Customs Adjudication have decided to send the letters to both the departmental representatives of the Collectorates, Directorates and the aggrieved parties of the importers to inform the concerned Collectorate about the status of the case whether it is in any other court of law or not.

The sources further informed this scribe that the authorities concerned of the Collectorate of Customs Adjudication are also informed the Federal Board of Revenue (FBR) about the prevailing issue.
