SHC seeks comments from FBR, others on plea for release of industrial steam turbine

KARACHI: The Sindh High Court (SHC) has sought comments from the Federal Board of Revenue, Collector of Customs Port Qasim and others on a petition seeking release of a consignment of used industrial steam turbine.

Petitioner AF Steel Re-Rolling Mills moved the court, naming the Secretary Finance, Federal Board of Revenue’s chairman, Collector of Customs Port Qasim as respondents.

Advocate Ghulam Nabi Shar, who represented the petitioner, submitted that his client imported an old and used one unit complete steam turbine with alternator and standard accessories and sought its clearance when it arrived at the port on September 8.

The customs authorities examined the particulars of the consignment and observed that there is no separate mechanism to determine the value of used industrial steam turbine. Therefore, they applied the method used to determine the value of old and used generator sets and assessed the value of the petitioner’s consignment.

Aggrieved by the assessment, the counsel said, imported turbine falls within category of machines and classifiable under HS Code 8406.8100 and its value is assessed on the basis of its weight.

He requested the Court to order the customs authorities to reassess the value of the consignment. The Court was further requested to order provisional release of the petitioner’s consignment.
