FTO postpones hearing of case of M/s Silver Star versus RTO Sialkot

LAHORE: The Federal Tax Ombudsman (FTO) has adjourned the hearing of a case filed by M/s Silver Star Enterprises (Private) Limited versus Regional Tax Office (RTO)  Sialkot for July 21.

According to the details, Advisor to Federal Tax Ombudsman Munir Qurashi heard the case of M/s Silver Star Enterprises versus Regional Tax Office Sialkot in which the counsel for the appellant argued that the Regional Tax Office (RTO) Sialkot has failed to make payment of tax refund claims to the company during the last three years.

He said that Regional Tax Office Sialkot has collected excessive tax from taxpayer M/s Silver Star Enterprises Private Limited from last four years and it approached many times before the commissioner concerned for refunds but RTO Sialkot authorities did not pay the refunds claims.

The counsel of above said appellant argued that at the end we decided to approach Federal Tax Ombudsman (FTO) to interfere in this case and direct Regional Tax Office (RTO) Sialkot authorities to clear our refund claims as early as possible. The counsel of appellant said that Regional Tax Office should refund the excess collection at the end of year but failed to do so.

While on the other side Regional Tax Office representative argued that the appellant M/S Silver Star Enterprises Private Limited, has not submitted all the record in the Regional Tax Office on the basis the company is submitting its claim for refunds. If appellant provide accurate record in Regional Tax Office then RTO will check the record and refund the extra tax to appellant, after assessment.

Further said the RTO has collect accourate tax besides this if appellant has any doubt he should submit the complete record in RTO Sialkot.

After hearing the arguments from both sides the Adviser of Federal Tax Ombudsman Muneer Qureshi adjourned the case till next date for further hearing and directed the parties to appear on said date for further hearing.
