Customs Appellate Tribunal rejects appeal filed by M/s Abid Trading Company

LAHORE: Customs Appellate Tribunal on Wednesday rejected the appeal filed by the M/s Abid Trading Company against Director General Customs Valuation, Director Customs Valuation Karachi.

In his final remarks, Member Technical Imran Tariq said that the appeal was devoid of merit and was rejecting it with no order.

“The appellant failed to provide any proof against the order passed by Director General, therefore, there is no need to interfere in the order passed by DG valuation,” Imran Tariq said.

Precise fact of the case that appellant filed the case before the Customs Appellate Tribunal against the ruling of director customs valuation Karachi in which the director ordered the appellant to pay taxes and duties on the import of porcelain wares and glass wares according to the fresh value instead of the old prices.

At the time of ruling the prices of  porcelain wares and glass wares increased by 200 percent the appellant not satisfied with the order and filed the case before the director customs valuation those also passed the order against the appellant after hearing the case in detail.

The appellant filed the case before the Customs Appellate Tribunal on the grounds that the order passed by the DG and director of customs valuation not under the law and he wants to pay taxes and duties according to the old prices of porcelain wares and glass. He appeals to Customs Appellate Tribunal to hear the case and passed fresh speaking order.

On the other side the counsel of recipient department submitted para wise comments and denied the allegation by appellant.
