M/s Hero Motors approaches SHC for restoration of sale tax registration

KARACHI: M/s Hero Motors (Private) Limited approached the Sindh High Court (SHC), seeking restoration of its sale tax registration suspended by the customs authorities due to their alleged involvement in issuance of fake invoices or tax fraud case.

In its constitutional petition, counsel for the petitioner stated that the petitioner is manufacturer of tractors and is paying all liabilities regularly and registered with in-house assembling/ manufacturing facilities for Hero Russi tractor 500, 50HP, Hero Russi tractor 510, 57HP and  Hero tractor 801, 81HP.

According to the petitioner, officials of the tax authorities issued show cause notice and suspended the sales tax registration, alleging that the petitioner was involved in issuance of fake invoices or tax fraud.

The counsel stated that no fake sale tax invoice was ever issued by the petitioner, therefore, the act of the respondents is illegal and mala fide.

Citing Secretary Revenue Division, the Commissioner Inland Revenue Zone-I, Regional Tax Office Hyderabad as respondents, the petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary. He also pleaded the court to set aside the impugned notice and restore its sale tax registration.
