The court had observed in its order that “record shows that applicant/accused was shown as absconder in charge sheet. Accused is absconder since long and non-bailable warrant was already issued against him. The applicant/accused is deeply involved in transportation of smuggled HSD which was seized. The accused is the owner of the vehicle in which alleged smuggled HSD was transported. The offence committed by the accused is punishable with 14 years’ imprisonment and as such falls within the clauses of Section 497 cr.pc. The specific role had been attributed to the applicant/accused person. The charge-sheet shows that accused is fully involved in smuggling therefore the bail before arrest application is hereby rejected”.
