KARACHI: The Sindh High Court (SHC) suspended the impugned demand notices for recovery of income support levy on several constitutional petitions filed by Arif Habib, Asad Ahmed, Mussarat Ahmed, Muhammad Ahmed, Farhan Ahmed and others against the impugned notices issued by the tax authorities.
A two-member bench, comprising Justice Aqeel Ahmed Abbasi and Justice Muhammad Arshad Khan, was hearing the petitions.
During the hearing, counsel for the petitioner submitted that many constitutional petitions are pending before the court on this matter in which court had granted stay orders therefore court may pass an interim order. After their arguments, the court suspended the impugned demand notices and issued notices to the tax authorities and deputy attorney general of Pakistan and also directed them to file their respective para-wise comments on the next date of hearing. The court adjourned the hearing for March 09, 2017.
Earlier, counsel for the petitioners stated in the constitutional petitions that the tax authorities issued them impugned demand notices for recovery of impugned income support levy, however they have no power to demand such income support levy from petitioners.
Citing Secretary of Ministry of Law, Sectary Revenue Division, Deputy Commissioner Inland Revenue Unit-01, (E & C) Zone-IV, Large Taxpayer Unit-IV, Commissioner Inland Revenue Unit-01, (G & C) Zone-IV, Large Taxpayer Unit as respondents, the petitioners pleaded with the court to set aside the impugned demand notices and restrain them from said recovery till final decision of their petitions.
