Collector Adjudication Seema issues show cause notice to M/s Sohail Enterprises Peshawar

ISLAMABAD: Collector Customs Adjudication Seema Raza Bukhari issued a show cause notice to M/s Sohail Enterprises Peshawar due to tax evasion of Rs5.1 million. The show cause notice was issued in contravention case no. 223/2018 reported by Customs Collectorate Peshawar.

According to the show cause notice, it has been reported that during the audit of Customs Dryport Peshawar for the Financial Year 2013-14. It was detected that the textile fabrics imported by M/s Sohail Enterprises Peshawar on payment of sales tax on reduced rate and resulting in short realization of government revenue of Rs5.1 million.

The notice further stated that M/s Sohail Enterprises Peshawar has not paid duty/taxes and thus recoverable under the provision of the section 32(3-A) of the Customs Act 1969, Section 3 of the Sales Tax Act 1990, and Section 148 of Income Tax Ordinance 2001.

Meanwhile, in light aforesaid report and in exercise of the power vested under Section-179 of the Customs Act 1969, the collector Adjudication has issued a show cause notice to the owner of M/s Sohail Enterprises Peshawar as to why not the evaded amount of duty/taxes amounting Rs. 5.1 million should not be recovered and why penal action should not be taken against him under Section 156 (1) (9) (14) of the Customs Act 1969 read with the section 33(5) of the Sales Tax 1990,and Section 182 (1) (15) of the Income Tax Ordinance 2001.
