M/s Musterhaft Apparel Private Limited moves SHC against detention of imported consignments

KARACHI: M/s Musterhaft Appareal Private Limited has approached the Sindh High Court (SHC) and filed a constitutional petition for de-block/ restore the petitioner user ID password/ NTN number/ business licenses of the petitioner as well as release of consignment of 653. 10sq meters ceramic tiles from China, only used for bullet proof jackets.

On 7 June 2021, counsel for the petitioner stated that the petitioner in the normal course of business, imported a consignment 653. 10 sq meters ceramic tiles from China, only used for bullet proof jackets for HQ FC Balochistan as per demands, not for any other purpose use, nor for commercial purpose use for value of US$ 40,708.23.

He argued that during the examination, customs officials confirmed that the instant item is not covered in the ADD notification and scanned justification, completed/ finalized and out of charge the goods declaration on Oct 18, 2019 under section 80 of the customs act, 1969.

He stated that the deputy collector of customs issued a demand notice dated Jan 18, 2021 demanded the anti-dumping duty amounts for Rs23,62,347 without jurisdiction re-open past & closed transaction out of charged/ completed/ finalized goods declaration on Oct 18, 2019, under section 80 of the customs act, 1969.

Counsel added that the petitioner is left with no other alternative, adequate and efficacious remedy available to him under the law, therefore, the petitioner has no other option but to approach this court by invoking the constitutional jurisdiction of this court, furthermore, the petitioner has not filed any other petition and this is the first petition on the subject, the petitioner craves to submit further grounds at the time of final hearing of this petition.

Citing secretary revenue division, chairman FBR and collector of Customs Appraisement West as respondents, petitioner pleaded the court to direct them to assigns or any other person acting on his behalf to release the hold/ de-block/ restore the petitioner user ID password/ NTN number/ business licenses of the petitioner as well as release the consignment of the petitioner of goods declarations according with law, forthwith, in the best interest of justice.
