FAISALABAD: Customs Adjudication Additional Collector Beelam Ramzan has ordered to confiscate the consignment of M/s Elite Enterprises, as no one appeared before the authority to defend the allegations.
As per details, M/s Elite imported a container No WHLU-547541-6 from UAE consisting of trolleys, TV casing, trolley suit cases soft type, furniture, LED TVs 32 inch brand Samsung model UA32 and other goods. The said consignment was transshipped from Karachi to Faisalabad Dry Port through bonded carrier namely as Jeelan Logistics (Private) Limited.
After arrival of the said container, neither importer nor his authorised person approached for clearance of their consignment; therefore, the Customs Import Branch seized items along with container under Section 157(2) of the Customs Act, 1969.
It was also observed that the condition as well as packing of goods was in bad condition and not up to the mark. It was suspected that pilferage of cargo has been taken place and high tariff goods have been replaced with low tariff goods. It is pertinent to mention here that an FIR No 06/2015 was lodged against the accused company and case was referred to the adjudication.
Appraiser Muhammad Jameel Ahmed and Inspector Amjad Iqbal Cheema appeared in adjudication department but no one appeared to defend the case from respondent’s side.
Therefore, the additional collector ordered to seize goods under Clause 14 of Section 156(1) and Section 157(2) of the customs act and a penalty equal to three times of the value of goods was imposed under Clause 14, 14 A, 43 and 63 on the importer as well as on the bonded carrier.
