Additional Collector Adjudication issues ONO in NDP vehicle case

LAHORE: Additional Collector Customs Adjudication Zahra Haider has issued Order-in-Original (ONO) No 06/2017 by declaring seizure of non duty paid Toyota Hilux Surf bearing registration no: MD-070 as legal.

Brief facts of the case are that ASO team intercepted a Toyota Hilux Surf near Kalma Chowk Ferozepur Road Lahore. The person available on the driving seat claimed the ownership of the above said jeep and introduced himself as Mudassar Zubair son of Zubair Fareed. On demand the said owner failed to produce any legal documents regarding possession of the vehicle.

Initially the said vehicle was detained under section 2 (kk) of Customs Act, 1969 for want of import documents. During the course of investigation, a notice was issued to the said owner under section 26 of Customs Act, 1969 requiring therein documents pertaining to legal import of the said vehicle but the said owner did not turn up even after a lapse of sufficient time. The said Surf was referred to the Punjab Forensic Science Agency. The report stated that the chassis number of the said vehicle has not been tempered. While the computerized data of MRA Islamabad was checked which revealed that the registration no: MD-070 (Islamabad) had been allotted to another Toyota Hilux Surf. In view of the above said report it was crystal clear that the detained Toyota Hilux Surf was plying on the road with fake registration mark and brought into the country in breach of the restriction and prohibitions for the time being in force by evading duty and taxes.

After examining the whole case Additional Collector Zahra Haider declared the seizure of non duty paid Toyota Hilux Surf as legal.
