FAISALABAD: Collectorate of Customs Adjudication Deputy Collector Asma Hameed has ordered to confiscate smuggled items along with vehicle being used for transportation of the items as respondent failed to defend allegations.
Deputy Collector Asma heard a case filed by Faisalabad Customs Intelligence and Investigation against Mohammed Iftikhar and Nisar following the charges of smuggling. The deputy collector issued Order-in-Original (ONO) in favour of the customs department.
As per details, the staff of Customs Intelligence intercepted a Mazda truck bearing Registration No BRF-2086 at Shahkot Toll plaza Sheikhupur Road, Faisalabad. The officials recovered 24 rolls of dyed brown shade fleece fabrics, 145 cartons of tag pin, 30 cartons of loop lock about, 45 cartons of zip and other items.
The driver of the vehicle introduced himself as Mohammed Iftikhar. He was asked to produce documents relating to the goods loaded on the vehicle. He presented only a receipt No. 2897 issued by M/s Pervaiz Goods Transport Company, Faisalabad showing transportation of plastic good from Faisalabad to Sialkot. Therefore, the foreign origin recovered goods were seized under Section 2 (kk) and 17 of the Custom Act, 1969.
Later, the case was sent to the adjudication for further legal proceedings where a show cause notice was issued to accused person under Section 171of the Custom Act. But no one appeared from respondent side and no written reply was submitted.
After hearing arguments, the deputy collector issued ONO stating, “It is therefore, established that the respondents have nothing to defend against the allegations framed in the show cause notice. The case is therefore, decided on the bases of the facts and materials available on the file, the charge framed in the show cause notice stand established”. She also ordered to confiscate the goods under the customs laws.
