Appraisement-East lodges FIR against importers over mis-declaration, evading Rs 122 million

Cemi Zone, Pure Enterprises import pharmaceutical raw materials by describing wrong ‘SDO’, ‘Preservative ACJC’

KARACHI: The Appraisement-East has lodged an FIR against importers Muhammad Ali Chandna of Pure Enterprises and Ziauddin of Cemi Zone for importing pharmaceutical raw material with ambiguous description of ‘SDO’ and ‘Preservative ACJC’ and causing loss of Rs 122.23 million to the national exchequer.

The accused importer, Muhammad Ali Chandna of Pure Enterprises, is a resident of 1H 58, St # 4, Falcon Complex, Shaheed-e-Millat Road, Karachi, while another accused Ziauddin of Cemi Zone is a resident of 3/30, Liaquatabad No 3, Karachi.

The FIR was lodged for violating Sections 16, 32, 32A, 79 and 192 of the Customs Act, 1969 read with Section 33 of the Sales Tax 1990, Section 148 of the Income Tax Ordinance, 2001 and Section 3(I) of the Imports and Exports (Control) Act, 1950, punishable under clauses 9, 14, 14A, 46 & 86 of Section 156 (1) of the Customs Act, 1969 and allied laws.

According to details, the said importers were deeply engrossed in importing pharmaceutical material from China /India by mis-declaring the description of the goods with the intentions to evade the application of the Import Policy Order. Moreover, for the purpose of uncovering this odious crime, an in-depth inquiry was conducted by the custom officials in which the relevant record of the import was recovered from the database of the collectorate and also various consignments of similar goods were intercepted at the port area that had gone through the complete process of chemical analysis.

Moreover, a couple of consignment of identical goods lying at the port were also intercepted and subjected to chemical analysis, which were found to be pharmaceutical raw material, contrary to the declaration of importers as chemicals. Consequently, based on the results of chemical analysis, an FIR number 04/2015-R&D (East) dated 04-03-2015 was accordingly lodged against importer namely Muhammad Ali Chandna of M/s Pure Enterprises and his clearing agent Muhammad Ali Rajvani of Rajab Ali & Sons (CHAL 50), etc.

Scrutiny of data has indicated that Cemi Zone which bears National Tax Number 3648582-9 has cleared 10 consignments by declaring fabricated brand of Preservative ACJC-240-430 and SDO-222 HS Code 3824.9099 as against pharmaceutical raw material, while the actual description and HS Code of goods is Ibuprofen (2916.3910), Sulphamethoxazole (2935.0040) & Cefixime-Trihydrate (2941.9060).

Furthermore, the outcome of the chemical analysis and all-inclusive investigation by the customs authorities made it explicit that the importers intentionally mis-declared the goods’ description with the ultimate motive of evading the legitimate taxes and to get an escape from all such restrictions that were preserved in the Import Policy Order in vogue.

Hence, the importers caused a huge loss of revenue to the tune of Rs 122.23 million by importing the banned product.

Therefore, an FIR has been lodged against the accused importers and efforts are underway to nab the culprits involved in the crime.
