KARACHI: The Sindh High Court (SHC) directed customs officials to submit detail and comprehensive para-wise comments on petition filed by Namatullah seeking release order for 16 LEDs Samsung seized by customs officials.
On September 07, 2018, a two-member bench, headed by Justice Ashraf Jahan, heard the matter.
During the hearing, counsel for the petitioner argued that customs officials had seized his 16 LEDs Samsung brand due to disputed valuation and other reasons, however, deputy collector of Customs Adjudication-1 directed customs officials to release his goods after payment of duty and taxes.
He argued that he fulfilled all the legal formalities and paid duty, taxes and penalty fixed by customs authorities, however, when he approached the concerned officers for releasing his goods then they declined his request.
During the hearing, Dr Shah Nawaz appeared behalf of respondents and filed power of attorney (wakalatnama) and sought time to prepare the case; therefore, the court directed him to make sure filing his comments on next date of hearing. The court also directed other respondents to file their comments.
Citing Secretary Ministry of Finance, deputy collector of Customs Adjudication-1, Fayyaz Anwar, Director Directorate General of Intelligence & Investigation-FBR as respondents, he pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary. He also pleaded the court to direct them to release his goods immediately and restrain them from taking any coercive action against him till final order in this petition.
