LAHORE: Collectorate of Customs Adjudication Collector Ambreen Ahmad Tarar has issued Order-in-Original No. 225/2017.
Brief facts of the case that on a credible information Customs I&I received information that M/s Numeric Distribution Network Private Limited was importing “Camel” branch cigarettes on which federal excise duty (FED) was not paid according to customs laws.
It was also revealed that printed retail price was factually found incorrect as ascertaind on the basis of the declared value of the imported cigarettes by the importer himself vide import documents submitted at the time of clearance. The respondents have intentionally mis-declared the retail price and evaded a huge amount of duty and taxes leviable thereon.
Therefore the charges of mis-declaration of retail price which according to applicable rule is the basis of determining the federal excise duty of the imported cigarettes and evaion of duty and taxes leviable threon leveled against the respondents in the contravention report as well as in the show cause notice stand established. Evaded amount of duty and taxes to the tune of Rs9,06,52,424/- is adjudged against the M/s Numeric Distribution Network and penalty of Rs1,00,00,000 is also imported upon M/s Agility Logistics Private Limited Garden Town Lahore.
The company and their clearing agent is hereby directed to clear the outstanding and evaded amount of duty and taxes at the arliest to avoid stern action.
It is necessary to mention here that Customs Adjudication expedited its efforts to conclude the hearing of pending cases on priority basis.
