Collector Adjudication-II Ch Javaid issues notice to Pakistan Mobile for tax evasion of Rs 71.8m

KARACHI: Collector, Collectorate of Customs Adjudication-II Ch Muhammad Javaid has issued a show-cause notice against M/s Pakistan Mobile Communication for evading duties/taxes to the tune of Rs 71.8 million.

In the show-cause, the Collector said M/s Pakistan Mobile Communication Ltd imported 30 consignments of cellular infrastructure equipment for telecom sector consisting of VRLA Gel Battery (12V), Rechargeable Battery (12V) and SBS EON 190 (12V) by mis-dcelaring them under PCT heading 8507.2012 (which is a specified heading for Lead Acid Batteries used in Telephone Exchanges) chargeable to Customs Duty at 10 percent instead of declaring them under their correct PCT heading 8507.2090 chargeable to Customs Duty at 20 percent.

It is pertinent to mention here that the same importer has cleared the similar goods under PCT heading 8507.2090. Other importers have also imported similar goods under PCT heading 8507.2090.

Thus by the way of mis-declaration of classification, M/s Pakistan Mobile Company Ltd with active connivance of their clearing agents M/s Saspak Cargo and M/s Eastern Freighters has deliberately and willfully evaded the amount of Rs71,850,248.

The hearing in this case is fixed for October 28, 2016. The importer and clearing agents may submit their written replies if any. The importer/clearing agents may also appear in person through their accredited representatives on the stipulated date ant time in my chamber situated at Customs House.

In case no one appears on behalf of the importer/clearing agent or no written reply is received by the stipulated date, the case will be decided exparte on merit as available record.
