LAHORE: Collector of Customs Adjudication Zafar Akhtar has declared seizure of Toyota Land Cruiser, bearing chassis number UZJ100-0136229 as legal.
The collector said that he thorougly examined the case record and heard the argument put forth by the seizing agency.
The respondents neither responded to the show cause notice nor appeared to defend their case despite they were provided ample time and opportunity. He added that due to the reason the charges leveled against them in show case stand established.
He added that consequently he ordered that the Land Cruiser was outrightly confiscated under clause (89) of section 156(1) of the Customs Act, 1969. In view of clause (a) of SRO449 (1)2009, option u/s 181 of Customs Act, 1969 cannot be allowed, he added.
The Land Cruiser was seized by Customs Intelligence and Investigations team at Lalak Chowk Defense and the vehicle was reported to be the non-customs paid.
The man who was driving the vehicle introduced himself as Muhmmad Imran and he showed copy of ONO issued by collector of Customs Chaman Quetta vide C.NO 1225 Veh-Amensty /HCC/2013, delivery order No 37136 dated 28.5.2913 issued by inspector MCC Chaman in which order in Original No 448 dated 28.03.2913 was mentionit leaged , payment challan no 375 dated 27. 03.2013 bearing file No 1225/ Amensty CHC/2013 showing payment of duty and taxes amounting to Rs 15,60,250 of Toyota Land Cruiser Jeep model 2002 issued by National Bank of Pakistan (NBP) Customs both, Quetta and other documents . On query he also informed that he was a driver and personall servant of Amir Hameed S/O Raja Abdul Hameed R/O House NO B-45, Mohallah South Sea View Avenue , Phase-II DHA, Karachi .
He also informed that the owner of the vehicle was also Amir Hameed who failed to appear before Adjduciation authority despite issuing several notices.
