Collector Appraisement East submits reply in SHC against M/s Kamla Brothers

KARACHI: Collector of Customs Appraisement East has submitted reply before the Sindh High Court (SHC) and claimed that petitioner is involved and has deliberately concealed/ mis declared the discretion of its imported goods, therefore, petition may be dismissed on a constitutional petition filed by M/s Kamla Brothers.

On 22 October 2021 a two-member bench heard the matter. During the hearing, Iqbal Khan Advocate for Collector of Customs Appraisement East, Kafeel Ahmed Abbasi Deputy Attorney General, Hussain Bohra, Assistant Attorney General appeared before the court.

During the hearing, Iqbal Khan Advocate submitted comments and stated that M/s kamla Brothers electronically filed goods declaration on September 24, 2018 with their clearing agent to contain glass mosaic tiles assorted seize.

Iqbal Khan Advocate further submitted that during the examination, customs officials found porcelain mosaic tiles mesh mounted fancy with flexible mesh backing size 30&30 CM Net WT 18750 kg Approx was also found which was not declared.

Iqbal Khan Advocate added that importer tried to in aforesaid facts prove that the importer has deliberately concealed/ mis-declared the description in order to take an attempt for getting to goods suppressed vale for evading legitimate amount of taxes to the tune of Rs3,389,940 willfully with malafide intention, therefore, court may dismiss said constitutional petition.

During the hearing, no one appeared on behalf of the petitioner, the court took comments on record and directed counsel for the petitioner to attend the court for the next date of hearing.
