Collector Basit issues ONO against Imran Enterprises for evading Rs 3.2m

KARACHI: Custom Adjudication Abdul Basit Chaudhary has issued Order-in-Original (ONO) against M/s Imran Enterprises for evading custom duty to the tune of Rs 3.2 million by mis-declaring the goods imported from Germany.

Meanwhile, the M/s Imran Enterprises has filed an appeal against the ONO before the Custom Appellate Tribunal, Bench–I Karachi.

According to the details, the case was made by the Model Customs Collectorate Port Qasim for mis-declaring the actual description, alleging that the Imran Enterprises attempted to clear alloy steel sheets at lower rate by evading customs duty amounting to Rs 3.25 million.

According to the contravention report of customs, M/s Imran Enterprises, Gujranwala imported a consignment from Germany described as consist of alloy steel sheets in coils secondary quality weighing 218,194 kilogram and filed goods declaration No KI-HXC 45806 dated March 11, 2015 for the clearance; thereof under PCT Heading 7225.9900 chargeable to custom duty at 10 percent.

However, on physical examination the custom shed staff reported that the actual description of the goods cannot be confirmed through the naked eye however, the description found on the basis of physical attributes and characteristics of the coil as secondary quality non-alloy steel coils classified under PCT heading 7210.4910 attracting duty at 20 percent since the goods were declared as secondary quality alloy steel sheet coil which attracts a lower tariff rate CD at 10 percent. Representatives samples were drawn from the consignment and sent to M/s A.Q Laboratories Rawalpindi for the confirmation of description and chemical composition of different elements, the goods declaration was assessed provisionally under Section 81 of the Custom Act, 1969 and goods were released.

A.Q Laboratories analyzed the samples and reported the weight composition of different elements given under chapter note 1(f) to chapter 72 of the Pakistan Custom Tariff for the goods to qualify as alloy steel.
