Counsel for the petitioner stated that it is engaged in the lawful import of varnish, including polyester/ polyamide (wire general varnish) and fulfills all the liabilities in accordance with law. The counsel argued that petitioner has no other remedy but to prefer the titled constitutional petition, challenging inter alia, imposition of the regularity duty.

Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Collector Customs Collectorate Appraisement West, Collector of Customs Collectorate Appraisement East and Collector of Customs Collectorate Appraisement Port Muhammad Bin Qasim as respondents, importer pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.

He also pleaded the court may set aside impugned valuation ruling and restrain them from taking any coercive action against the petitioner till final order in this petition.
