Customs Appellate Tribunal accepts appeal in seized gold & currency case

LAHORE: Customs Appellate Tribunal has accepted the appeal filed by Muhammad Taufeeq and others against Collector of Customs Preventive Lahore and others.

According to the details of case, staff of customs deputed at Allama Iqbal International Airport intercepted a passenger when he was about to board the plane. Passanger Abadul Basit  was travelling from Lahore to Dubai.

On querry, he stated that his trolley did not contain any contraband items. The trolly bag of his passanger was examined which was resulted into the recovery of huge quentaty of assorted foriegn currency and gold.

On demand he faild to produce lany egal documents showing lawful possession of the recoverd foriegn currency and gold bullion. The foriegn currecny amounting Rs 3, 32, 00, 000 and value of gold bullion was Rs6, 00, 00, 000 along with trolly bag and same were seized under the section 168(1) of Customs Act 1969.

After the show cause notice, adjudication proceeding were culminated and order in original was passed with remarks that respondent involved in the smuggling so the show cause notice is established and Panely of Rs20,00,000 is imposed on the respondent.

Being aggrived with the order, appellant challanged the order in origianal before the Customs Appellate Tribunal on the grounds that the report preparted and sent to adjudication is not concrete.

Adding more, the order in original passed in mechanical fashion without consideration of facts of case and same is liablet to set aside but the respondent denied allegaions and pray for the rejection of same appeal. After hearing the arguments Omer Arshed Hakeem, member judicial heard and examined the record and accepted the appeal.
