ISLAMABAD: A single bench of the Customs Appellate Tribunal heard three customs references filed M/s Lucky Enterprises, Haq Nawaz and Wasif Hussain during the fourth week of January. The bench also adjourned the hearing of the cases.
M/s Lucky Enterprises, Haq Nawaz and Wasif Hussain had filed cases against Model Collectorate of Customs and Directorate General of Investigation and Intelligence, Islamabad.
A single bench of the tribunal comprising member, Syed Muhammad Anwar, heard the cases. The bench would not hold hearing following other occupations.
Now the bench would resume the hearing on cases as per schedule by the tribunal’s administrative staff. The appellants had challenged various measures taken by field offices of Federal Board of Revenue (FBR).
M/s Lucky Enterprises, Haq Nawaz and Wasif Hussain had filed these cases. All of these cases had been filed during 2016. The cases were still pending with the tribunal. Earlier, these cases were heard by a single bench while now they were being heard by a division bench as per rules of tribunal.
M/s Lucky Enterprises had had filed the case against MCC. It had challenged a customs duty assessment sustained by the adjudication.
Haq Nawaz and Wasif Hussain had filed cases regarding release of vehicles which were seized by customs authorities amid attempt to smuggling various items.
The appellants had challenged department’s adjudication decision before the bench through the said cases. Adjudication had maintained charges against appellants during departmental hearings.
During previous hearing, the bench had adjourned hearing of said cases due to absence of responding counsels from the tribunal. However, the bench then had asked the assisting counsels on the provision of relating documents by the both sides. These appellants had also filed some other cases before the tribunal which were being heard by other benches.
