Customs Appellate Tribunal disposes of case of customs collector against Hijrat Khan

LAHORE: The Customs Appellate Tribunal has disposed of the appeal of Collector Customs Sambrial against Hijrat Khan and others.

In the final remarks, Chairman Justice (r) Malik Manzoor Hussain said that the amount determined by the tribunal in taxes and duties has been deposited by recipient and accepted by the appellant department, therefore, instant appeal has become in fructuous and the same is disposed of.

As per precise fact of case, on the information, staff of customs anti smuggling model customs collectotorate, Sambrial, was intercepted truck loaded with contraband, on inspection customs staff found smuggled foreign Sofa cloth and lassies.

The driver of truck failed to produce any legal document regarding lawful import so, the goods were detained under the relevant provisions of customs act 1969. After issuing show case notice adjudication officer passed the order in original for confiscation of goods and panely of Rs one lak was imposed on Hijrat Khan, truck driver, also order to confiscate truck.

Hijrat khan aggrieved from the order and filed case before learned collector (Appeals) which was modified impounded order passed by adjudication officer.

Against the impounded order collector customs and Hijrat khan filed case before the customs appellate tribunal, single bench heard the case and decided with the taxes and panelties to the Hijrat khan and order to release goods.

On the order of single bench collector of customs filed case before the division bench for hearing, before the division bench recipient Hijrat Khan produced attested copies of judgment, provides receipts provided by Pakistan Customs and deposited amount determined in the judgment.

Before tribunal, the learned counsel appear on behalf of department also verified the receipts produced by the respondent. After hearing case customs appellate tribunal dispose of case.
