Customs Appellate Tribunal disposes of reference filed by M/s Lucky Enterprises

ISLAMABAD: A single bench of the Customs Appellate Tribunal disposed of M/s Lucky Enterprises’ customs reference for non-prosecution on Wednesday.

The bench comprising member, Syed Muhammad Anwar, disposed of the matter after issuing repeated notices to the sides who had not appeared before the tribunal on the last date of hearing. The bench disposed of the matter for non-prosecution (DNP).

Earlier the tribunal had asked the counsels to prepare for final arguments in the customs reference pending with the tribunal for some weeks.

M/s Lucky Enterprises had filed the case against Customs Collectorate. It had challenged a customs duty assessment sustained by the adjudication.

The same bench had also disposed of a matter filed by Haq Nawaz. He had filed the case regarding release of vehicles which were seized by customs authorities amid attempt to smuggling various items. The bench dismissed Nawaz’s reference while had adjourned hearing on M/S Lucky Enterprises case for next week. Both of these cases had been filed during 2016.

The bench had also held hearing on said matter before. But these cases were pending with the tribunal. The bench had directed the concerned counsels to fully assist the bench on the matters in order to reach a just and fair decision.
