LAHORE: Customs Appellate Tribunal has decided a case of Naeem from Tehsil Kharian District Gujrat versus Additional Collectorate Customs Adjudication Lahore. Customs Appellate Tribunal member Judicial Bench II Omer Arshed Hakeem heard the case and issued ordered to release Toyota Hiace van bearing number BQU 116 Jaffarabad unconditionally to the real owner.
The staff of the Directorate Intelligence, FBR Gujranwala, intercepted a Toyota Hiace and asked them to provide documents of the vehicles. The driver of vehicle failed to produce original legal documents, import and lawful possession of the vehicle.
Directorate Intelligence forward the case to Motor Registration Authority Jaffarabad , while Motor Vehicle Authority failed to produce legal document regarding lawful import while MRA argued that their office was burnt in which all record was destroyed.
After arguments of Motor Registration Authority, the adjudication confiscated Toyota Hiace van bearing number BQU 116 Jaffarabad under clause- 89 of section 156-1 of Customs Act 1969. Naeem challenged the case in Customs Appellate Tribunal on 12 November 2013.
