Customs Appellate Tribunal orders to release aluminum foil unconditionally

LAHORE: Customs Appellate Tribunal settled appeal filed by M/s Teflon Ware Industries Gujranwala against Collector of Customs (Appeals) Lahore and others.

On 12 November 2018, after hearing the arguments from appellant and respondent, Muhammad Shabbir Gujjar, member judicial bench-I ordered the respondent/customs department to release goods of 6140 kilograms of scrap and aluminum. The impugned order is modified and appeal stands disposed of.

According to the brief facts reported by adjudication authority that in pursuance of an information, the staff of FBR Intelligence and Investigation Regional Tax Office Faisalabad intercepted a truck trailer loaded with container.

On demand, driver produced a copy of GD No KPPI-HC-1333 showing clearance of aluminum foil scrap weighing 51749 metric tons from Port Qasim, Karachi by M/s Teflon Metal Ware Industries, Gujranwala.

The information was authentic; therefore, the trailer along with container and loaded goods was brought to the MCC Dry Port Faisalabad. After the search, they recovered foreign origin aluminum foil 20130 kilograms and in rolls of different length and width 6140 kilograms. The goods were seized according to the Customs Act 1969.

The appellant filed the appeal before the collector of customs (Appeals) who ordered for auction of goods.

Being aggrieved with the order, the appeal was filed before the Customs Appellate Tribunal on the grounds that the order leveled in the show cause notice was totally against the facts and figures, and order passed by earlier authority is against the facts. After hearing arguments from both sides, Customs Appellate Tribunal disposed of appeal.
