Customs Appellate Tribunal orders release of goods after payment of 20pc redemption fine

LAHORE: The Customs Appellate Tribunal has ordered the release of a vehicle and container on payment of redemption fine equal to 20 percent of the value of the vehicle and container respectively in the case of Collector of Customs, Model Customs Collectorate, Dry port Faisalabad against Syed Liaqat Ali, a resident of Bhakkar and Collector Customs (Appeals).

Imran Tariq Member Technical-II declared in the judgement that after the complete document examination and hearing the arguments the recipient Syed Liaqat Ali failed to provide legal documents of imports. The tribunal orders that the goods be released on payment of duties and taxes on redemption fine of 20 percent of the values of the seized vehicle and container.

As per details, on the available information Superintendent Customs ASO Faisalabad intercepted vehicle loaded with computer accessories were transported to Faisalabad by mis-declaring in the clearance documents through Customs Dry Port Faisalabad. The container was taken into customs custody. The truck and container were seized under Import and Export Control Act 1950 and Customs Act 1969.

After issuance of show cause notice, adjudicating authority passed the Order-in-Original (ONOs) and order to release vehicle with container against redemption fine equal to 20 percent redemption fine.

The decision of Collector Customs (Appeals) challenged before the Customs Appellate Tribunal on the grounds that the case not decided on the merit and liable to be set aside, the impugned order is not speaking one and in the conformity with the law and other grounds. The recipient denied all allegations by the complainant.

After hearing the arguments, Customs Appellate Tribunal accepted the appeal filed by the department and order to release goods on the payment of duties and taxes with fine.
