LAHORE: Customs Appellate Tribunal ordered the appellant to pay the taxes and duties along with impugned redemption fine in appeal filed by Syed Rashid Ali against Collector of Customs Adjudication, Customs House Lahore.
Muhammad Shabbir Gujjar, Member Judicial Bench-I, heard the case in details and passed the order with remarks that there is no evidence of smuggling was found according to the Customs Act 1969. The appellant will pay taxes and duties along with redemption file and goods to be released to its lawful owner.
The case was reported by the Federal Investigation Agency to customs department for further action and to investigate the passenger Syed Rashid Ali, examined hand carry bag and take action under the law.
The case was adjudicated parties were heard the order in original was passed with remarks that impugned goods were confiscated.
Not satisfied with order the appellant filed the appeal before the Customs Appellate Tribunal that goods were seized in illegal matters and passed orders without consideration of facts of case so the same is liable to set aside. On the other side, respondent denied all allegations and prayed for the rejection of appeal.
After hearing arguments from both sides, Customs Appellate Tribunal decided case and directed to release goods after payment of duty, taxes and fine.
