LAHORE: The Customs Appellate Tribunal has set aside the impunged order in a case of Mir Ahmed, a resident of Dera Ismael Khan, versus additional collector of Customs Adjudication Faisalabad and superintendent Customs ASO Mianwali.
Tribunal Member Judicial Bench-II Omer Arshad Hakeem has sent back the case to the adjudication officer with directions to pass fresh order after providing a opportunity of hearing to both parties and receive evidences which they like to produce.
According to details, the staff of the customs ASO intercepted a Hino truck and the driver failed to produce any legal documents. The truck was detained under section 168 of the Customs Act 1969 for violation of section 2 (s) and punishable under section 156 (1) 89 (i).
After show case notice adjudication authority heard the case and passed order to confiscate the said Hino truck under section 156(1)89(i) of customs act 1969.
The appellant aggrieved from the decision and filed a case in Customs Appellate Tribunal on the grounds that the impunged order not fulfill the basic requirements. The recipients party denied the allegation and Customs Appellate Tribunal send back the case to adjudication officer for fresh speaking order.
