Customs Appellate Tribunal set aside ONO, orders to release vehicle

LAHORE: Customs Appellate Tribunal has accepted the appeal and set aside the Order in Original (ONO) in seized Hino truck. The same appeal was filed by the M/s Bitumen Traders against Deputy Collector of Customs (Appraisement) Lahore and others.

Muhammad Shabbir Gujjar, member Judicial bench-I heard the arguments from both sides and decided the appeal with arguments after examining all record the case concluded that Order in Original has set aside and appeal is accepted and also allowed to release goods to its lawful owner.

As per brief history of case, M/s Bitumen Traders was imported a Hino Concrete Transit Mixer truck and sought clearance under PCT Heading 8705.4000.

After the examination from the customs department some discrepancies are ground in between imported items and clearance note. The case was adjudicated and Order-in-Original was passed with remarks that appeal is rejected because this authority feels that there is no need to interfere in the same appeal.

The order was challenged before the Customs Appellate Tribunal on the grounds that Order-in-Original not according to the facts of case also passed beyond the law. Appellant counsel also produced some documents showing lawful imports of the same items and prayed before the tribunal that impugned order is liable to set aside. On the other side, respondents denied allegations and prayed for the rejection of appeal.

After hearing the arguments from both sides, Customs Appellate Tribunal has accepted the appeal and set aside the order passed by the earlier authority in the same case. Customs Tribunal also order to release goods to its owner.
