Customs Appellate Tribunal upholds ONO

LAHORE:Customs Appellate Tribunal on Friday has upheld the Order-in-Original (ONO) in seized Hino Loader case filed by the Amjad Ali, a resident of Mandi Bahauddin against the Collector of Customs (Appeals) and others.

As per brief histor of case, staff of Customs Anti Smuggling Origanization (ASO) was intercepted a Hino loader. The same vehicle were examinded in the presence of driver that produce belty and failed to produced documents proving lawfull import of said vehicle that was loaded with foriegn origin tyres and same were seized under the section 168 of Customs Act 1969.

After show cause notice, adjudication proceeding were culminated and order in original was passed with remarks that show notice is established. Not satisfied with the order and was filed before the Collector Customs Appeals who accepted the appeal partially.

Being aggrived with the order, appeal was filed before the Customs Appellate Tribunal that earlier both order passed without consideration of law and liable to set aside but respondent denied all allgations.

After hearing arguments from both sides, Omer Arshad Hakeem, member judicial bench decided the case with remarks that impugned order is upheld and instant customs appeal is dismissed with no order at cost.
