Customs Court grants post arrest bail to suspect involved in mis-declaration

KARACHI: Customs Court Judge Syed Faiz Rasool Rashdi on Saturday granted pre-arrest bail to Arif Humayun son of Muhammad Yameen, former chief executive officer (CEO) of AMI Pakistan (Private) Limited who was arrested in a case of mis-declaration which causes the loss to the tune of Rs 871,836 to the national kitty.

During the hearing, the counsel for the applicant submitted that the applicant is innocent and has been falsely implicated in this case and applicant is ready to join investigation and appear before this court. However, he said that he has the apprehension that the respondent will take him into the custody, therefore court may grant him pre-arrest bail.

However, the counsel for the department argued that the prosecution has sufficient evidences against the accused person which have been mentioned in the report. The suspect doesn’t have the right to get any relief; therefore, the court may reject his pre-arrest bail plea.

After the arguments from both sides, court granted pre-arrest bail to accused namely Arif Humayun son of Muhammad Yameen, former chief executive officer (CEO) of AMI Pakistan (Pvt) Ltd against the surety bonds of Rs 200,000.

According to the prosecution, in view of facts and documentary evidences in possession and circumstantial evidences, it is established without any of doubt that accused and his associates have violated the provisions of section 9,32 (1), 32  (2), 32A, 79, of the Customs Act, 1969 punishable under clauses 10 (A), 14, 14A and 46 of section 156 ( 1 ) of the Customs Act, 1969.
