KARACHI: The Sindh High Court (SHC) disposed of the constitutional petition along with all pending applications filed by M/s Package Limited against Customs officials lodging first information report (FIR).
On 19 March 2021, a two-member bench, headed by Justice Muhammad Junaid Ghaffar and Justice Agha Faisal heard the matter.
During the hearing, Ijaz Ahmed, advocate for the petitioner, Syed Mohsin Imam, advocate for the respondent, Kafeel Ahmed Abbasi, Deputy Attorney General, Tahir Zafar, I.O./Assistant Director, Audit appeared before the court.
During the proceedings, the investigation officer submitted that FIR bearing No.ST/DD-B/01/2014-15/24 dated 19.01.2015 has been quashed by the Special Judge, Customs and Taxation, against which the department has not preferred any further appeal or remedy.
On statement of the investigation officer, the court passed an order and observed that “in the circumstances, this petition has served its purpose and has become infructuous, as the impugned notice under section 37 of the Sales Tax Act, 1999 was based on this very FIR.
Accordingly, this petition, along with pending application, is disposed of, whereas the respondents are directed to conduct in accordance with law and/or shall not cause any harassment to the petitioner.
In so far as the prayer clause (iii) is concerned, the petitioner is at liberty to challenge the same in appropriate proceedings. Petition is disposed of in the above terms with all pending applications”.
