Customs Court seeks comments on petition filed by M/s Minhas Construction

KARACHI: The Sindh High Court (SHC) directed customs officials to file their para-wise comments on a constitutional petition filed by M/s Minhas Construction seeking release of imported used asphalt power machine Voglee Super seized by customs officials due to alleged violation of import policy.

A two-member bench, headed by Justice Abdul Rasool Memon, heard the matter on July 17, 2018. After hearing, the court directed customs officials to consider request of the petitioner for release of its vehicle.

During the hearing, counsel for the petitioner stated that it is engaged in the lawful import of machinery for construction and it imported a used asphalt power machine Voglee Super and filed goods declaration for release. However, it was informed by the customs officials that it was restricted due the violation of alleged import policy. Counsel argued that same nature of goods were also released by the customs officials.

Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Customs Collectorate, Collector of Customs Port Muhammad Bin Qasim and others as respondents, petitioner pleaded the court to release its goods and restrain them from taking any coercive action against the petitioner till final order in this petition.
