Customs directed to settle M/S Anchor Commodities’ case within 7 days

KARACHI: The Sindh High Court (SHC) directed the customs authorities to decide the application of the M/S Anchor Commodities Private Limited, seeking release of the surety, within a week.

A two-member bench, headed by Chief Justice Sajjad Ali Shah, was hearing the petition filed by M/S Anchor Commodities that seeks the benefit of Fifth Schedule of the Customs Act, 1969 on its consignment of “drip irrigation system”.

During the hearing, counsel for the respondent assured that the application of the petitioner for release of the surety would be decided within a week.

Earlier, the petitioner’s counsel stated that petitioner was engaged in the lawful business of manufacturing of forestry machinery and imported a consignment of “drip irrigation system” and filed goods declaration on November 13, 2014 claiming the benefits–concessionary rate of customs duty zero percent, sales tax zero percent and income tax 5.50 percent.

According to the petitioner, it requested the Customs Appraisement-East collector to release the consignment under but it has not been released till today.

Citing Revenue Division secretary, Customs Appraisement-East collector, Inland Revenue (sales tax) member as the respondents, the petitioner pleaded the SHC to order to release the consignment of the petitioner.
