DC Asma gives culprit an option to receive goods on payment of duties

FAISALABAD: Collectorate of Customs Adjudication Deputy Collector Asma Hameed ordered the seizure of miscellaneous goods under the customs bylaws besides giving an option to redeem the culprit of smuggling on payment of duties and taxes.

Deputy Collector Asma Hameed issued an Order-In-Original (ONO) No: 24/2017 while hearing a case against one Lal Khan, son of Haji Ahmed, a resident of district Khushab. The items were recovered by the Field Unit Sargodha Customs Intelligence and Investigation.

Following an actionable tip-off regarding the smuggling of miscellaneous goods, the customs staff intercepted a trailer bearing registration No: TLE-375 near Mianwali Toll Plaza on M.M Alam Road. The trailer was loaded with F/O 21 cartons of crockery, 30 pieces of LED smart TV, CPU without HD CPU Xeon 13-CTN, digital receivers with card 1 CTN, 50 pieces of mother board with remote for TV, 21 CTN TV screen of LED, 26 CTN LEDs for back plastic cover news and cigarette-lighters with torch new158 CTN coming from Karachi to Rawalpindi.

The officials asked the driver to show documents regarding the legal import of the items, but he failed to produce the same. So the officials confiscated the goods under Section 17 of the Custom Act-1969 read with Section 2(s) and sent the case to the adjudication.

Culprit Lal Khan appeared in the office and claimed the ownership of the recovered foreign origin items. He also submitted an affidavit on the stamp paper separately showing his willingness to pay duty and taxes. The customs representative said the seized items were brought into Pakistan illegally by evading duties and taxes.

After hearing arguments, DC Adjudication announced that, keeping in view the willingness of the owner, an option is given to the lawful owner under Section 181 of the Custom Act 1969 read with SRO-449 (1) to redeem his respective seized goods on the payment of duties and taxes.
