FAISALABAD: Collectorate of Customs Adjudication Deputy Collector Asma Hameed ordered to confiscate 1150 kilogram of fabric and carrier vehicle.
The deputy collector issued Order-in-Original (ONO) while hearing a case against Muhammad Yasin and Muhammad Azam registered by the Customs Intelligence and Investigation.
In pursuance of information, the Customs Intelligence intercepted a Mazda Truck bearing Registration No LES-2083 near Shahkot Toll plaza, Sheikhpura Road, Faisalabad and recovered 1150kg knitted jersey fabric.
The driver of the vehicle introduced himself as Mohammed Yasin son of Ghulam Haider. He was asked to produce documents relating to the goods loaded on the vehicle but he could not produce any evidence in this regard. Therefore, the foreign origin cloth was detained under Section 2kk and 17 of the Custom Act, 1969 read with section 3(1) of the import and export, Act 1950 punishable under section 156(1) 89 of the custom Act.
Therefore, Mohammed Yasin and Kashmir Garments, Faisalabad were called upon to show cause as to why the seized goods should not be confiscated under aforementioned provisions of law.
Inspector Asghar Mehdi Naqvi appeared from the prosecution side and asserted that seized cloth fell in the ambit of Section 2(s) of the custom act 1969, while Mohammed Azam appeared on the behalf of party and stated that seized cloth was purchased by the respondents vide sales tax invoice No. 168 from the M/s Tawakal Traders Karachi who imported this against GD No. KAPW-HC – 123874.
But, the respondent failed to produce any valid documentary evidence regarding lawful import of the seized cloth, so the adjudication authority ordered to confiscate the goods.
