KARACHI: Customs Intelligence and Investigation-Enforcement Director Muhammad Yaqoob Mako has advised the Appraisement-West to not take action against M/S Symbol Industries Private Limited, as differential amount of duty/taxes has been collected.
The director further asked to implement the Order-in-Appeal passed by the Customs Appeals collector in an appeal filed by the importer M/S Symbol Industries, Karachi against the Order-in-Original (ONO) No 487/2015 dated February 23, 2016 passed by Customs Adjudication deputy collector.
The Customs Appeals collector vide in Appeal Order 786/2016 has set aside the redemption fine and penalty imposed on the importers and clearing agents vide the impugned ONO on the grounds that there has been no mis-declaration in the instant impact and the goods are found, as importer has submitted pay orders for the principal amount, which was short levied.
Therefore, Customs Intelligence-Enforcement Director Muhammad Yaqoob Mako has advised the Appraisement-West to not to pursue the matter further in view of the fact that no mis-declaration of description i.e tale master batch was observed during the course of physical examination and that the importers voluntarily deposited principal amount. This directorate is of the opinion that no further appeal against the impugned order of the Customs Appeals is necessitated.
Director Yaqoob Mako has also enclosed the pay order in original for Rs 954,570 and Rs 20,322 respectively for deposit in government treasury after re-assessment of GD no KAPW-HC 132586 Meanwhile the GD has been de-blocked for re-assessment by the collectorate, added Maku.
