Faisalabad Customs Adjudication orders to confiscate cloth

FAISALABAD: Custom Adjudication Deputy Collector Asma Hameed has ordered to confiscate cloth by deciding the case in favour of Customs Intelligence and Investigation.

According to the case history, the Customs Intelligence intercepted a bus bearing Registration No. LES-12- 5737 and recovered foreign origin cloth, which was brought into the country through an unauthorised route without payment of custom duty/taxes. Therefore, the recovered cloth was seized under section 168 of the Custom Act, 1969.

On the other hand, the accused persons namely Rai Muhammad Akram Iqbal Waheed Ullah and Ajmal Khan claimed the ownership of the seized cloth. They also submitted a written application wherein they requested the court to release their cloth upon payment of leviable amount of duty and taxes.

Meanwhile, the deputy collector reviewed all the stated facts. Hence it is proved that the seized cloth is smuggled one.

Therefore, order for confiscation of the seized cloth in favour of the federal government under Section 156(1)89 of the Customs Act, 1969.

As the respondent showed willingness to pay the taxes; therefore, the court ordered that the accused could get release of their cloth by paying 20 percent redemption fine.
