Faisalabad: Investigation & Prosecution Unit recovers millions of rupees sales tax

FAISALABAD: The Investigation and Prosecution Unit of the Regional Tax Office, Faisalabad, was established in March, 2013, at the Second Floor of the Additional Block of the RTO Building and was declared as Sales Tax (Investigation & Prosecution) Police Station, vide the then Chief Commissioner, RTO, Faisalabad’s letter No. CCIR/RTO/FSD/6808 dated 16.05.2013, addressed to the Home Secretary (Punjab), Lahore for the purpose of investigation and prosecution under Section 37-A & B of the Sales Tax Act, 1990 for the purpose of to condemn malpractice in Sales Tax fraud cases as defined under Section 2(37) of the Sales Tax Act, 1990. The Investigation and Prosecution Unit is supervised by the Commissioner/Additional Commissioner of respective zone and headed by the Chief Commissioner, RTO, Faisalabad.

The Investigation and Prosecution Unit has lodged eight FIRs up till now and a huge amount of revenue has been detected/ recovered in various Sales Tax mega fraud cases.  The unit has recovered sales tax amounting to Rs 333.635 millions.  It is pertinent to mention here that in only two cases, namely M/s GMSA Industries (Pvt.) Ltd., Faisalabad and M/s Seth Tufail Foundary (Pvt.) Limited, Faisalabad, the unit has recovered Rs 150 million and Rs 90 million, respectively.

Investigation & Prosecution Unit, promptly start movement and gathered the relevant/allied information/documents in respect of the case on the basis of Complaint(s), detection of Fraud(s), bogus/fake documents, any other valid/solid information or concrete evidence(s) received from any source/agency, complainant as well as third party information and then after thorough examination of material evidence available on record with the department, if the case is fit for investigation, then approval to conduct investigation under Section 38 is sought from the concerned Commissioner through Additional Commissioner.  After getting approval, I & P Unit issue a letter/summons to the parties concern for production of relevant documents/record/evidence related to that inquiry/ investigation.  If, the party or his legal Advisor/ITP failed to satisfy the department, then this office again issue Summons to the defaulter(s) for appearing in person and submission his written defense, if any.  When element of tax fraud is established, then case is recommended for FIR to the Chief Commissioner through concerned Zonal authorities.  Comprehensive figures of Sales Tax detected as well as recovered are given as under: –

Beside above figures, in only TEN cases, where Sales Tax investigation proceedings were initiated, and resultantly, zone-wise amounts detected and deposited are as under: –

Total consolidated recovery of the RTO is Rs.650 millions i.e. in lieu of Section 40B, 37, 38 (FIR & Investigation) cases.

 

The officers/officials posted in the I &P Unit are very trustworthy/reliable, efficient, willing, hard working, paying keen interest as well as very professional and ensure secrecy in respect of their jobs/duties as and when assigned irrespective their nature of duties, even ready for prompt action all the time 24/7 and to try their best to do every thing what they can do in the best interest of the department under the leadership of Mr. Muhammad Afzal Malik, ACIR/IO.  In fact, all the officers/officials posted in the I & P Unit are liable to be awarded special cash reward as well as credential certificates just to acknowledge their best performance and professional skill.

According to a source Mr. Muhammad Afzal Malik, ACIR I & P Unit, RTO, Faisalabad vehemently stated that the best efforts are being made to restrain massive Tax evasion and strict action will be taken against tax fraudsters and there is no space for the tax evaders/fraudulent in the territorial jurisdiction of the RTO, Faisalabad.  He further reiterated that coercive measures will be taken to eradicate malpractices within the respective jurisdiction of the RTO, Faisalabad.  I & P Officer also stated that all our achievements we gain with the best team work under the kind supervision of Mr. Nasir Khan, Commissioner IR and Head of the Department, lady Chief Commissioner.
