LAHORE: The Federal Tax Ombudsman (FTO) has adjourned a case filed by proprietor The Royal Trading Company Lahore against the Regional Tax Office (RTO-II) Lahore until the next date of hearing.
FTO Advisor Tariq Yousaf Consultant (I&M) heard the case filed by Muhammad Umer, proprietor of The Royal Trading Company Lahore. The counsel for appellant argued that the RTO has failed to release the sales tax refund to the appellant since two years.
He said the RTO-II collected excessive tax from the company during the last two years. The petitioner approached the officials concerned several times for issuance of the refunds, but the RTO officials failed to clear the refunds even after the passage of reasonable time.
Finally, the appellant decided to approach the FTO seeking interference in this case. The counsel appealed the FTO advisor to direct the RTO-II to clear the refund claims.
The counsel further said the delay in issuance of refunds put the burden on the taxpayer as the RTO-II should make audit of the cases and release the extra amount collected by it from the taxpayer.
On the other hand, counsel for RTO-II argued that the appellant has not submitted all record in the office for claim of refunds. If appellant provides accurate record, the RTO-II will issue the refunds after a proper assessment, he added.
After hearing the arguments from both sides, Advisor Tariq Yousaf adjourned the case of proprietor of The Royal Trading Company Lahore until next date for further hearing and directed the parties to appear before him on the said date to present arguments in the case.
