IHC adjourns hearing of six cases filed against ATIR

ISLAMABAD: The Islamabad High Court (IHC) heard and adjourned six important cases involving Appellate Tribunal Inland Revenue and Customs Appellate Tribunal.

The IHC division benches comprising Justice Shaukat Aziz Siddiqui and Justice Mohsin Akhtar Kayani, Justice Noor-Ul-Haq N. Qureshi and Justice Athar Minallah, and Justice Aamer Farooq and Justice Miangul Hassan Aurangzeb heard the cases.

According to details, Justice Shaukat Aziz Siddiqui and Justice Mohsin Akhtar Kayani heard the sales tax matter filed by Messers Nowshera and adjourned further proceedings with directions to sides to ensure appearance before the court on the next hearing. Messer Nowshera had filed the reference in 2015 in which it had challenged an ATIR decision before the IHC.

The same bench heard another sales tax matter filed against Customs Appellate Tribunal, Islamabad. Hearing of this case was adjourned following absence of counsels from the court. Muhammad Shahzad Aslam had filed the case in which he had challenged appellate tribunal’s decision before the IHC.

Justice Noor-Ul-Haq N. Qureshi and Justice Athar Minallah heard the case filed by Pakistan Mobile Communications Limited (PMCL). PMCL had challenged an ATIR decision before the court through the petition.

IHC division bench comprising Justice Aamer Farooq and Justice Miangul Hassan Aurangzeb heard tax references based on federal excise duty and sales tax. M/s CMPak Limited had filed the federal excise duty reference in which it had challenged a decision pronounced by ATIR. Sales tax reference was filed by Islamabad Electric Supply Corporation (IESCO). IESCO had too sought relief against an ATIR decision. The court adjourned hearing for third week of June.

The bench also heard an income tax matter which is filed by Gabor Nagi against the ATIR and dated the case in office.
