ISLAMABAD: Islamabad High Court on Wednesday adjourned hearing of couple of tax references filed by M/s Wi-Tribe Pakistan challenging recovery notices issued by the field offices of Federal Board of Revenue (FBR).
A division bench comprising Justice Athar Minallah and Justice Miangul Hassan Aurangzeb held initial hearing of income tax references filed recently against show cause notice issued in August for tax year 2015. Through the references, the company had made LTU Inland Revenue (IR) chief commissioner, IR withholding assistant commission, IR (Appeals) commissioner and Federal Board of Revenue (FBR) chairman respondents in the case.
The company had prayed the court to direct LTU not to recover the said amount and abstain from any coercive action against it.
The petitioner had also asked the court that operation of the impugned notices issued by the tax authority may kindly be suspended till the decisions of appeal pending before the LTU.
It also submitted before the court that the impugned show-cause notices were issued under mala fide intentions and had no legal standing or authority and the court may decide on relief which it deemed appropriate in this regard. It also stated that due legal course was not followed by the department in issuing the orders.
