IHC bars FBR to recover outstanding amount from M/s Din Sons Ltd

ISLAMABAD: A single bench of Islamabad High Court (IHC) has restricted the Federal Board of Revenue (FBR) from recovering outstanding tax amount of Rs11.363 million from M/S Din Sons Limited.

Hearing the tax matter filed by M/s Din Sons Limited, the IHC single bench comprising of Justice Aamer Farooq also directed the Regional Tax Office, Islamabad to decide the pending appeal of appellant challenging imposition of said tax liability.

The appellant had challenged Regional Tax Office order, dated March 16, 2016, stating the recoverable tax amount in head of sales tax payable at 16 percent rate against services of value Rs 70,853,460. The order was issued under provisions of Sales Tax Act, 1990.

FBR RTO’s Chief Commissioner, Commissioner Inland Revenue, Commissioner Inland Revenue (Appeals) and others were made respondent in the case.
